Terms and Conditions

The ARTSask website seeks to maintain and provide public access to a collection of works of art and to further the knowledge, understanding and enjoyment of visual art.  The University of Regina maintains this website, in co-operation with its partners in the ARTSask Project, for your entertainment, information, and education.

The following important Terms and Conditions govern your access to and use of this website. Please take time to read them, before you continue on to enjoy this site:

1.   Copyright

The images, text, audio and video clips, documentation, illustrations, designs, icons, software and all other content on the website are protected by Canadian and international copyright laws.  The content on the website may be covered by other restrictions as well, including copyright and other proprietary rights held by third parties.  The University of Regina and its ARTSask Project partners, as applicable, retain all rights, including copyright, in data, images, text and any other information contained in the site. 

Copying of any protected content on the site is expressly forbidden, except for purposes of fair dealing, as defined by Canadian copyright law, and as described below.

2.   Fair Dealing - Uses Requiring No Further Permission

The information contained in this website is provided as a courtesy.   The University of Regina makes every attempt to ensure the accuracy and reliability of the information contained in the site.  This information is provided “as is” and the University and makes no representations or any warranty as to the accuracy or completeness of the information contained in this site.  The University, its employees and agents will not be responsible for any loss, however arising from the use of or reliance on this information.

The materials on this site are provided for browsing, viewing, downloading, and listening for limited non-commercial, educational and personal use only. 3.  Uses Where Permission is Required

Commercial publication, or any unauthorized exploitation or distribution of the content contained herein is expressly prohibited without written permission from the University of Regina, and where applicable, other institutions and third party rights holders.

Many of the images contained in this site are part of the collections of institutions other than the University of Regina; please contact the appropriate institution directly for permission to reproduce these images.   For all other permission to use images or content, please contact ARTSask at ARTSask@uregina.ca .  Permission to use works or materials in this site is granted on a case-by-case basis and in the complete discretion of the rights holder.  A fee may be charged, depending on the type and nature of the proposed use.  It is the responsibility of the applicant to secure permission from third party rights holders and to clear such rights prior to the use of ARTSask content.

4.   Links to the Site

We encourage other web sites to link to the home page of this site, as a normal link. Content from this site may not be used within a frame, or by means of an in-line link.
Users that wish to create specific links to web pages within the site must request permission in advance by contacting the ARTSask Webmaster and provide details regarding the proposed use. Upon the review and in consultation with the ARTSask Project partners as required, the University of Regina will determine whether to approve the proposed in-line link, and if so, provide more detailed and specific guidelines for the use and citation of the content to which the in-line link will be created.

5.   Links to External Sites

This website may contain links to other websites.   While the University of Regina makes every effort to link to websites that are useful for ARTSask Project users and share our high standards for fairness and integrity, the privacy and data collection on any linked website are entirely separate and are not covered by these Terms and Conditions.  As the parties that maintain these sites may not be subject to the Official Languages Act, information found on these sites may not be presented in an official language.

Other websites may also link to this site without our knowledge or consent.  The University of Regina bears no responsibility for their content, policies or actions.

6.   Trademarks

Many of the trademarks, service marks, and logos, (collectively called the "Trademarks") displayed on this website, including the logos of ARTSask and the ARTSask Project partners, are registered and/or unregistered marks of the Project and its partners.  The Trademarks of third parties may also be displayed on this site. Nothing contained in this site should be construed as granting any license or right to use any Trademarks on the site without the express written permission of the University of Regina, its ARTSask Project partners or any third party that may own the Trademarks displayed on the site, as appropriate. Any unauthorized use of a Trademark is strictly prohibited.

7.   Content Posted to or Transmitted from the Site

All comments or suggestions and any content posted to or transmitted by a user to the site are not confidential and become the property of the University of Regina.  The University and its ARTSask partners may 1) reproduce, disclose, transmit, publish, broadcast, and telecommunicate to the public any such content and post any such content at its sole discretion; and 2) use any idea, concept, know-how or technique that a user posts for any purpose, including developing, manufacturing and marketing products or other material.

You may not post to or transmit from this website any content which is threatening, libelous, defamatory, obscene, pornographic, threatening, invasive of privacy or publicity rights, abusive, or otherwise illegal, or objectionable that could constitute a criminal offense, violate the rights of any party, or give rise to liability or violates any law. The University of Regina assumes no responsibility and liability for any such content.

8.  Privacy Policy

This website is owned by the University of Regina.  The University recognizes its obligations to the clients, stakeholders, the community and online visitors to adhere to the highest standards of fairness and integrity in its operations. As such, the University of Regina has a privacy policy that governs this site and is set out as follows.

9.   Monitoring Usage and Use of Personal Information

The University of Regina takes all steps to make all information received from our online visitors as secure as possible against unauthorized access.  However, please keep in mind that no data transmission over the Internet is 100% secure and any information disclosed online can potentially be collected and used by parties other than the intended recipient.
